These Terms of Service (“Terms”) govern your access to and use of the Email Manager Pro platform and related services (the “Service”) provided by AMI Software LLC (operator of “Email Manager Pro”; “we”, “us”). By creating an account or using the Service, you agree to these Terms.
You must be at least 18 and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Keep your password and API keys secure and notify us promptly of any unauthorized use.
Email Manager Pro provides a control center and connectable devices for collecting, cleaning, verifying, classifying, and delivering email data. Features and modules may change, and we may add, modify, or discontinue parts of the Service over time.
You agree not to use the Service to:
You are solely responsible for the email you collect, process, and send, and for compliance with all laws applicable to your sending.
You retain ownership of the data you import or generate (“Customer Data”). You grant us a limited license to host and process Customer Data solely to provide the Service. Our handling of personal data is described in our Privacy Policy.
Devices run on infrastructure you control. You are responsible for the security, lawful operation, and sending reputation of any servers and IP addresses you use with the Service.
Paid plans are billed in advance on a recurring basis through our payment provider. Fees are non-refundable except where required by law. We may change pricing with notice; changes apply to subsequent billing cycles. Failure to pay may result in suspension or termination of the Service.
Free or trial access may be subject to limits and may be modified or withdrawn at any time. We may impose reasonable usage limits to protect the Service.
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or for prolonged non-payment. Upon termination, your right to use the Service ends; you may export Customer Data before closure where reasonably practicable.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that verification or deliverability results will be complete or accurate.
To the maximum extent permitted by law, Email Manager Pro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold Email Manager Pro harmless from claims, damages, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which AMI Software LLC is established, without regard to conflict-of-laws principles. Disputes will be subject to the courts of that jurisdiction unless otherwise required by applicable law.
